KASUS UU ITE

1. Based on tirto.id. Emi is a housewife from Bantul Yogyakarta who was reported for her writing on Facebook. On July 9th, 2014, Emi was reported to the police and became a suspect for defamation on social media. At first, she only wrote her confession about her husband who was almost got fired.

“Iya sih pak Har baik, yang nggak baik itu yang namanya Ayas dan spv (supervisor) lainnya. Kami rasa dia nggak pantas dijadikan pimpinan Jolie Jogja Jewellery. Banyak yang lebay dan masih labil seperti anak kecil!” she wrote. She did not expect that the supervisor, Ayas would bring her tweet to the police.

2. Emi violated UU ITE or Information and Electronic Transaction chapter 27 verse 3 number 11 year 2008. This chapter explains about prohibited acts from using technology and spread the information.

“Setiap Orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan penghinaan dan/atau pencemaran nama baik”

3. Based on chapter 45 UU ITE in Indonesia,

“Setiap Orang yang memenuhi unsur sebagaimana dimaksud dalam Pasal 27 ayat (1), ayat (2), ayat (3), atau ayat (4) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp1.000.000.000,00 (satu miliar rupiah).”

So, the suspect of this case must be jailed maximum of six years or pay the fine maximum of Rp 1.000.000,00 (one billion rupiahs).
